University bursaries in England are often linked to household income assessed through Student Finance England (or the equivalent body in Scotland, Wales, or Northern Ireland). The Education (Student Support) Regulations 2011 (as amended) govern the student finance system. Charitable bursaries and scholarships are governed by the charity's own terms and the Charities Act 2011. Under the Equality Act 2010, bursary providers must not discriminate on the basis of protected characteristics, although positive action provisions allow targeted support for underrepresented groups. Some bursaries may have tax implications — generally, bursaries and scholarships for tuition fees and living costs are exempt from income tax under Section 776 of the Income Tax (Trading and Other Income) Act 2005, but amounts above the cost of tuition, fees, and maintenance may be taxable.
