Bus lane enforcement is governed by the Traffic Management Act 2004 (Part 6) for civil enforcement and local traffic regulation orders (TROs) made under the Road Traffic Regulation Act 1984. In London, additional powers are provided by the London Local Authorities and Transport for London Act 2003. A bus lane restriction must be properly signed with the correct traffic signs as specified in the Traffic Signs Regulations and General Directions 2016. The TRO must be validly made and in force. Motorists can check the operational hours of bus lane restrictions — many bus lanes only operate during peak hours. The CCTV evidence relied upon by the council must clearly show the alleged contravention. Adjudicators at the Traffic Penalty Tribunal have ruled in favour of appellants where signage was inadequate, where the motorist was avoiding an emergency vehicle, or where the TRO was defective.
