Do I need a receipt when selling a car privately?

There is no legal requirement for a written receipt, but it is strongly advisable. A receipt provides evidence of the sale, the agreed price, and the condition of the vehicle. It protects both the seller (by confirming the sale and 'sold as seen' terms) and the buyer (by recording what was agreed and any representations made). Both parties should keep a signed copy.

What does 'sold as seen' mean?

Sold as seen means the buyer accepts the vehicle in its current condition after having had the opportunity to inspect it. In a private sale, the seller does not need to guarantee the vehicle's quality or fitness. However, 'sold as seen' does not protect the seller from claims of misrepresentation — if the seller lied about the mileage, history, or condition, the buyer can still take legal action under the Misrepresentation Act 1967.

Do I need to notify the DVLA when I sell a car?

Yes. The seller must complete the V5C/2 (New Keeper Supplement) section of the V5C registration certificate, give it to the buyer, and send the rest of the V5C to DVLA, Swansea, SA99 1BD. You can also update the record online at gov.uk. The buyer cannot tax the vehicle until the DVLA has updated the record, so prompt notification is important.

What if the car has outstanding finance?

If the vehicle has outstanding hire purchase (HP) or personal contract purchase (PCP) finance, the seller does not legally own the vehicle — the finance company does. Selling a vehicle with outstanding finance without the finance company's permission may be a criminal offence. The buyer should check for outstanding finance using an HPI check or similar vehicle history service before purchasing.

Can the buyer return a car bought privately?

In a private sale, the buyer has very limited rights to return the vehicle. Unlike purchasing from a dealer, the Consumer Rights Act 2015 does not apply. The buyer can only seek a remedy if the seller misrepresented the vehicle (e.g. lied about the mileage, accident history, or number of previous owners). In such cases, the buyer may claim under the Misrepresentation Act 1967 or, in serious cases, report fraud to the police.

Private vehicle sales in the UK are subject to general contract law and the Misrepresentation Act 1967. Unlike sales from traders, private sales are not covered by the Consumer Rights Act 2015 requirements for goods to be of satisfactory quality or fit for purpose. The principle of 'caveat emptor' (buyer beware) applies. However, the seller must not misrepresent the vehicle — for example, stating the mileage is genuine when it has been clocked is fraud under the Fraud Act 2006.
