Cookie use in the UK is governed by the Privacy and Electronic Communications Regulations 2003 (PECR) (SI 2003/2426), as amended. Regulation 6 requires that consent be obtained before storing or accessing information on a user's device, except for cookies that are strictly necessary for the provision of an information society service explicitly requested by the user. The ICO's guidance on cookies (updated regularly) makes clear that consent must meet the UK GDPR standard: it must be freely given, specific, informed, and given by a clear affirmative action. Pre-ticked boxes and implied consent from continued browsing are not valid. The ICO has enforcement powers under PECR, including the power to issue monetary penalty notices of up to £500,000 for serious breaches. However, the ICO has indicated it takes a proportionate approach and focuses enforcement on organisations causing the most harm.
