Important Notes
Property boundaries in England and Wales are determined by the title deeds and plans registered at HM Land Registry under the Land Registration Act 2002. Title plans show general boundaries only (Land Registration Rules 2003 Rule 278). The Party Wall etc. Act 1996 applies to shared walls and structures on the boundary. Adverse possession of registered land is governed by Schedule 6 of the Land Registration Act 2002 (10-year rule). The Civil Procedure Rules pre-action protocols require parties to attempt negotiation and ADR before issuing proceedings. HM Land Registry offers a boundary determination service under Section 60 of the Land Registration Act 2002, though this is rarely used due to cost.
