Council tax banding in England and Wales is governed by the Local Government Finance Act 1992. Property bands are based on the open market value of the property as at 1 April 1991. The Valuation Office Agency (VOA) is responsible for assigning bands. Under Section 16 of the LGFA 1992, a council taxpayer can make a proposal to alter the valuation list. The Council Tax (Alteration of Lists and Appeals) (England) Regulations 2009 set out the procedure for proposals and appeals. If the VOA rejects the proposal, the taxpayer can appeal to the Valuation Tribunal for England (VTE) under Section 16(7). Important: a challenge can result in the band being increased as well as decreased — the VOA reviews the banding afresh and is not limited to the direction of the challenge. Research comparable properties thoroughly using the VOA website (gov.uk/council-tax-bands) before making a challenge.
