Can my council tax band go up if I challenge it?

Yes. This is an important risk to be aware of. When the VOA reviews your property's banding, they assess it afresh and may conclude that the property is actually in too low a band. If this happens, your council tax could increase. Research comparable properties carefully before making a challenge. If most similar properties in your area are in the same band or higher, a challenge is unlikely to succeed and could backfire.

How do I find out what band my neighbours are in?

You can check the council tax band of any property in England and Wales for free on the GOV.UK website at gov.uk/council-tax-bands. Simply enter the postcode or address. This is the most important research to do before challenging your band — look for properties that are similar to yours in size, type, and age but are in a lower band.

What are the council tax bands based on?

In England and Wales, council tax bands are based on the open market value of the property as at 1 April 1991. Band A is up to £40,000 and Band H is over £320,000 (1991 values). If your property did not exist in 1991, the VOA estimates what it would have been worth if it had existed at that date. Scotland uses similar bands but with different value thresholds.

How long does a council tax band challenge take?

The VOA aims to respond to proposals within 2 months, but complex cases can take longer. If you disagree with the VOA's decision and appeal to the Valuation Tribunal, the appeal process can take several months. During the challenge, you must continue paying council tax at your current band. If the band is subsequently reduced, you will receive a refund of the overpayment.

Can I get a council tax refund if my band is reduced?

Yes. If the VOA agrees to reduce your band, the change is usually backdated. In most cases, it will be backdated to when the current valuation list came into effect (1 April 1993 for the current list) or to when a material change occurred. Your council will calculate the overpayment and either refund it or credit it against future council tax bills.

Council tax banding in England and Wales is governed by the Local Government Finance Act 1992. Property bands are based on the open market value of the property as at 1 April 1991.
