Under Section 86 of the Employment Rights Act 1996, an employee who has been continuously employed for one month or more must give at least one week's notice. Resigning with immediate effect without serving the required notice constitutes a breach of contract unless the employer has itself committed a fundamental or repudiatory breach. In cases where the employer's conduct amounts to a fundamental breach of the employment contract, the employee may be entitled to resign without notice and bring a claim for constructive unfair dismissal under Section 95(1)(c) of the Employment Rights Act 1996. To succeed in such a claim, the employee must generally show that the employer's breach was sufficiently serious, that they resigned in response to the breach, and that they did not delay too long before resigning (thereby affirming the contract). If you believe you have been constructively dismissed, you should seek independent legal advice.
