The Employment Rights Act 1996, Section 86, requires employees to give at least one week's statutory notice if they have been employed for one month or more. Contractual notice periods that exceed the statutory minimum are enforceable and take precedence. If you resign without serving the full contractual notice, you are in breach of contract. In practice, employers rarely pursue claims for breach of contract relating to short notice, but they are entitled to do so. Some contracts include a clause permitting deductions from final pay equivalent to the unserved portion of the notice period. Before offering short notice, check your contract for any such clauses. Your employer is not obliged to agree to a shorter notice period — but many will do so if asked professionally. If they refuse and you leave anyway, the risk of legal action is low but not zero. You remain entitled to be paid for all time worked and for any accrued but untaken statutory holiday under the Working Time Regulations 1998.
